Nova Scotia residents may be interested to learn of the case of a man that was recently awarded more than $268,000 in damages in relation to a car accident that occurred in 2006. Though some might consider this sum substantial, the judgement reflects a 20 percent reduction of the damages the man might otherwise have been awarded; according to the judge, he reduced it because he did not feel the victim has done enough to recover.

Nova Scotia Man Sentenced for Role in Fatal Accident

A Nova Scotia man was sentenced on June 4 for his role in a single-vehicle drunk driving accident that claimed the life of a 51-year-old man. The 52-year-old Cumberland County resident was given a custodial sentence of four and a half years in addition to a 20-year driving ban after entering a plea of guilty to charges that he had operated a vehicle in a criminally negligent manner. The fatal accident took place in Pugwash Junction in 2011.

A Nova Scotia man described his experience of his sedan nearly being hit by loose logs after a log truck lost its load on March 14. On 3 p.m. that Friday, he was travelling from Sweets Corner to the Windsor hockey arena where he served as a coach during the mid-afternoon when he saw the log truck take a corner too quickly. He noticed the end of the load began to break free and fall off the truck. He knew that he couldn't avoid the car accident or dodge all of the logs coming toward him on the road. He accelerated, turned hard to avoid the logs and rolled his vehicle into a ditch. He explained that his sedan suffered serious damage after it flipped end over end.

They are checking records for the type of car that was seen driving away from the accident. Fatal U-Turn Leads to Woman's Death

The victim was the passenger of a Volkswagen Jetta vehicle being driven by a 25-year-old man. The Jetta attempted to execute a U-turn across two separate traffic lanes and was struck on its front passenger side by a 2011 GMC Sierra. Both drivers were taken by ambulance to a nearby hospital, but the victim died at the scene of the crash.

After an accident such as this, it may be necessary to thoroughly review the collision analyst's report in order to ascertain which party may be held liable for damages. It is possible that the GMC driver was distracted in some way and so failed to see the Volkswagen vehicle turning in front of him, but it is also possible that the Volkswagen driver should not have attempted the U-turn in the first place.

If the negligence of another person causes a fatal accident, he or she may be held accountable to the victim's family for damages suffered due to the loss. The family of the deceased in this crash may be entitled to compensation from the driver who caused the accident.
