In 2011 Wagners filed a class action on behalf of individuals who since 2001 have received a Wright Profemur Hip Implant System and have suffered a fracture.

It is alleged the hip implant system fractures prematurely, requiring revision surgery.

The Wright Profemur national settlement has been fully administered. All approved claimants have been sent their awards and the applicable appeal deadline has passed.

Certification was granted on June 25, 2014. The Defendants unsuccessfully appealed the certification decision, and unsuccessfully sought leave to appeal to the Supreme Court of Canada. Following further court appearances on trial-related issues, the parties are preparing for a common issues trial.
