Update - April 6, 2016

We have received the Certification Order which has now been signed by the Honourable Justice Ouellette confirming the certification of the Miramichi Pathology lawsuit as a class action. A copy of the Order may be found under the Court Documents tab along with the Notice of Certification, Opt-Out and Opt-In forms.

We suggest that all Class Members take a moment to read the Order and documents so that they are familiar with their legal rights concerning the class proceeding. Please contact us if you have any questions.

The deadline for individuals wishing to opt-out or opt-in to the class action is July 1, 2016. Wagners must receive any completed opt-out or opt-in forms on or before this date.

Notice of Certification is now being carried out pursuant to the terms of the Order. 

Update - April 1, 2016

On Thursday, March 31, 2016, documents were filed with the Supreme Court of Nova Scotia seeking certification of the proposed class action concerning the crash of Air Canada Flight 624 at the Robert Stanfield International Airport on March 29, 2015.

Update - February 12, 2016

On Saturday, February 20, 2016, lawyers Raymond Wagner, Q.C. and Madeleine Carter of Wagners will host an information meeting for the benefit of former students of the Schools for the Deaf in Nova Scotia who have expressed interest in the class action concerning abuse and neglect at the schools.

The February 20th meeting will commence at 1:00 p.m. and will take place at The Holiday Inn Express & Suites, 400 Main Street, Saint John, New Brunswick.

The purposes of the meeting are to meet the legal team and representative plaintiffs as well as to learn more about how the class action process works.

In the not too distant future similar meetings will be held in Sydney, Cape Breton and Halifax. We will contact class members and post information on this page once the future meeting particulars have been finalized.

Update - February 11, 2016

The Supreme Court of Canada has released its decision with respect to the application for leave to appeal filed by Wright Medical Group Inc. with respect to the Nova Scotia Court of Appeal's decision upholding certification of the Wright Medical Hip Implant class action

The SCC has dismissed, with costs, the leave application. The lawsuit is now confirmed to proceed by way of a class action.

Update - February 8, 2016

Our agents in Ottawa have advised Wagners that the Supreme Court of Canada's decision with respect to the Defendants' Application for Leave to Appeal the Nova Scotia Court of Appeal's decision upholding the successful certification of the Wright Medical class action will be released on Thursday, February 11, 2016. 

Update - January 29, 2016

Ray Wagner and Madeleine Carter from Wagners and Joe Fiorante of CFM Lawyers appeared on behalf of the plaintiffs at the initial case management conference before Justice Boudreau on January 28, 2016. Counsel for all named Defendants also appeared at the conference.

Discussions were held concerning the proceeding and the logistics involved in proceeding to the certification motion.

We are pleased to advise that the motion to certify the class proceeding will be held in December 2016. Below is a schedule of the significant events that will lead up to the December hearing:

Update - January 28, 2016

Update - January 21, 2016

Wagners has been contacted by many persons who have suffered side effects or other issues associated with the fertility medication Bravelle.

Our firm is actively investigating the situation concerning the recall in October 2015 of four lots of Bravelle by the manufacturer of the medication, Ferring Pharmaceuticals. The lots were recalled due to a short than expected half-life which degrades the potency and effectiveness of the medication.

We encourage class members to please take a moment to review the updates so that they are informed on the current status of the matter.

The next significant event in the OxyContin class action is the hearing of the Plaintiffs' motion for certification which is scheduled to be heard on April 4, 5 & 6, 2016 in the Ontario Superior Court.

Update - January 13, 2016

Wagners Law Firm filed a Notice of Action and Statement of Claim on January 13, 2016 naming the Attorney General of Nova Scotia as the defendant in a proposed class action lawsuit.

The class action was filed on behalf of Richard Martell and Michael Perrier who are representing a group of individuals who have come forward with allegations of sexual, mental and physical abuse at two schools for deaf students in the Province of Nova Scotia. Presently over 150 individuals have signed up to be a part of the legal proceeding.

On today`s date, Wagners filed a proposed class proceeding with respect to the emissions defeat device contained in vehicles manufactured by Volkswagen under the brands VW, Porsche and Audi.

The most recent version of the Plaintiffs' Statement of Claim was filed with the Court of Queen's Bench in Miramichi, New Brunswick, with respect to the class action concerning pathology errors at the Miramichi Regional Hospital. Update - July 14, 2015

Ray Wagner, Q.C., Michael Dull and other members of Wagners attended the 2015 Public Justice Trial Lawyer of the Year Award presentations last night in Montreal. Messrs Wagner and Dull were chosen as a Top 5 finalist for Public Justice's prestigious award due to their work on the case involving the former residents of the Nova Scotia Home for Colored Children. Also in attendance at the ceremonies was Harriet Johnson, one of the Representative Plaintiffs in the class action.

Although our firm did not receive the award for Trial Lawyers of the Year, we wish to acknowledge Public Justice for selecting our work on the Home as a worthwhile finalist for their award. We also wish to congratulate the legal team who were presented the award for their work on the case known as David v. Signal International, as well as the other finalists and all members of the bar and their legal teams for their undaunted and unwavering work in seeking justice for those who otherwise may not have the opportunity to seek it.

Update - July 7, 2015

The Nova Scotia Court of Appeal has released its decision concerning the appeal filed by the Defendant, Wright Medical, which sought to reverse Justice Wood's decision which certified the proceeding as a class action.

The appeal was denied and a copy of the Decision may be found on the Wright Medical Court Documents tab.

The proposed class proceeding was filed on behalf of residents and property owners who are affected by the water seepage from the Deer Lake Canal.

Wagners and Buckingham Law are working cooperatively on behalf of the affected residents.

Update - April 28, 2015

Wagners Law Firm and Camp Fiorante Matthews Moderman jointly filed a proposed class action against Air Canada, its pilots, Halifax International Airport Authority, Transport Canada, Airbus S.A.S. and Nav Canada concerning the crash of Air Canada Flight 624 at Halifax Stanfield International Airport on March 29, 2015.

The lawsuit was filed in the Nova Scotia Supreme Court on April 28, 2015. A copy of the filed Notice of Action and Statement of Claim may be viewed on the AC624 Court Documents tab.

Update - February 26, 2015

The Nova Scotia Supreme Court released its decision today concerning the Plaintiff's Motion for Certification with respect to the East Coast Forensic Hospital. The motion was heard by the Honourable Justice Denise Boudreau of the Supreme Court of Nova Scotia on Friday, January 30th.

Justice Boudreau has certified the lawsuit as a class action. The Decision may be viewed on the ECFH Court Documents tab.

Update - January 29, 2015

Ray Wagner, Michael Dull and Madeleine Carter appeared before the Nova Scotia Court of Appeal today to respond to the appeal which has been filed by the Defendants in the Wright Medical class action. The case was successfully certified on June 25, 2014 by Order of the Honourable Justice Michael Wood. The Defendants are attempting to overturn the certification decision. The Court of Appeal has reserved its decision. Once the decision has been released the Wright Medical page will be updated.

Raymond Wagner has been invited to speak at the annual We Free Day in San Patrignano, Italy on October 15, 2011. Mr. Wagner will speak on the topic of OxyContin.

The We Free Day is an international event aimed at increasing awareness about harms to health, society and the environment caused by drug use, trafficking and production. Along with other pre-eminent representatives of the United Nations, UNODC Colombia, Italian Government, members of various institutions, politicians, scientists, journalists and researchers, Ray will attend the conference to discuss these topics that are of concern to many.

Of great importance is the fact that the We Free Day involves more than 2000 high school students and also hosts several youth organizations from all over the world (USA, Canada, Colombia, Uganda, Cambodia, UK, Portugal, Italy etc.). Social projects using tools like dance, hip hop culture etc. to save teens from drug addiction and risky behaviours, promote a culture of freedom from drugs, help individual self esteem and enrich communities serve to assist our youth in making right choices in life.

Mr. Wagner will discuss the blurring of the boundaries between legal and illegal substances, the expanding market of legal drugs and diseases, the availability of a pill for every sort of problem or pain, physical or psychological, the over prescription of drugs and the misleading communication and marketing actions of Pharmaceutical Companies as in the case of OxyContin.

In a landmark ruling issued February 8, 2008, Alberta's Courts struck down the government's cap on soft-tissue injury claims, declaring it unconstitutional. Justice Wittmann said the legislation discriminated against a specific group of injured Albertans by removing their right to sue for pain and suffering.

The legislation essentially singled out an identifiable group of injured Albertans and arbitrarily marginalized them by declaring them less deserving of compensation than other Albertans injured due to the fault of others. The Court found that the 'cap' legislation violated section 15(1) of the Canadian Charter of Rights and Freedoms.

Section 15 is aimed at preventing the "violation of essential human dignity and freedom through the imposition of disadvantage, stereotyping, or political and social prejudices, and to promote a society in which all persons enjoy equal recognition at law as human beings or as members of Canadian society, equally capable and equally deserving of concern, respect and consideration." (Law v. Canada, [1999] 1 S.C.R. 497)

The Alberta Court's adherence to the equality guarantees of the Charter in striking down that province's 'cap' legislation, while not strictly binding, bodes well for the Constitutional Challenge currently being brought against similar 'cap' legislation passed by Nova Scotia's Conservative government in November of 2003.
