Brown & Dee v. General Motors of Canada et al

Nova Scotia Supreme Court File: Hfx No. 427140 

Wagners commenced a proposed class action proceeding in the Supreme Court of Nova Scotia on May 9, 2014 against the United States and Canada GM companies with respect to the defective ignition switches.

On February 7, 2014, General Motors Company reported a safety recall to the National Highway Traffic Safety Administration, a service of the United States Government. A few days later, on February 10, 2014, Transport Canada issued Road Safety Recall #2014038, followed on February 12, 2014, wherein GM sent a letter to all dealers of GM and GMC vehicles.

On February 24, 2014, GM reported a further safety recall to the National Highway Traffic Safety Administration and again shortly thereafter Transport Canada issued Road Safety Recall #2014060. Then on March 4, 2014, GM and GMC sent a letter to all dealers of GM and GMC vehicles.

On March 17, 2014, the CEO of GM offered an apology in the United States for the safety issues concerning the ignition switch. During that apology the CEO admitted that GM knew of the ignition issues for nearly 10 years.

  • Update – December 11, 2015

    We are continuing to monitor the efforts of the lead counsel who are prosecuting the General Motors ignition switch class action.

  • Update – July 21, 2015

    It is our understanding that law firms in other provinces in Canada are continuing in their efforts to proceed with the case on a a national basis.

    When the other law firms across Canada who are involved in the GM class actions provide us with further information, we will update this page with the most recent news.

  • Update – July 16, 2014

    Our Notice of Action and Statement of Claim has now been served on the Canadian and American entities of GM. Counsel has been retained by both.

    We have asked Counsel for the Defendants for their position on requesting a Case Management Judge be assigned to the proceeding. We are awaiting their response.

  • Update – May 9, 2014

    On May 9, 2014, Wagners filed a Notice of Action and Statement of Claim with the Supreme Court of Nova Scotia on behalf of those individuals who have been subjected to a recall of certain vehicles manufactured by General Motors due to a safety issue with a defective ignition switch. The following documents concerning the class action which has been filed by Wagners as a result of the ignition switch issues common to numerous automobiles manufactured by General Motors are available for viewing in PDF format:

Wagners is presently accepting enquiries from individuals who owned vehicles which are subject of the recall by General Motors concerning the ignition switch defect.

The following vehicles, manufactured by General Motors, are subject to the recall:

  • CHEVROLET COBALT 2005-2010 models
  • CHEVORLET HHR 2006-2011 models
  • PONTIAC G5 2007-2010 models
  • PONTIAC PURSUIT 2005-2006 models
  • PONTIAC SOLSTICE 2006-2010 models
  • SATURN ION 2003-2007 models
  • SATURN SKY 2007-2010 models

If you are an owner of one of the above vehicles, you may be eligible for inclusion as a Class Member in our proposed class action lawsuit.
