Wagners filed a proposed class proceeding on behalf of residents of Canada who claim to have suffered personal injuries allegedly as a result of the Mirena Intrauterine System, a birth control device manufactured by Bayer. The action was filed on April 23, 2013 in the Supreme Court of Nova Scotia in Halifax.

In 2009, the FDA issued a warning to Bayer for overstating the effectiveness of Mirena, while minimizing the risks associated with it. Among these alleged risks is uterine perforation which can necessitate the need for surgical removal.

If you or someone you know has suffered from uterine perforation allegedly as a result of having received a Mirena IUD, you may wish to contact Wagners.

Patients using the Mirena IUD should consult with their physician should they have any concerns with regard to continuing or discontinuing their use of the Mirena IUD.

Wagners is presently accepting enquiries from residents of Canada who have been implanted with the Mirena IUD birth control device and have suffered injuries or damages.

Counsel appeared before the Honourable Justice Gerald Moir on June 18, 2014 for a further Case Management Conference.

We are awaiting the position of the Defendants with respect to the future course of this proceeding.

Counsel will be appearing before the Honourable Justice Gerald Moir on April 24, 2014 for a Case Management Conference.

The hearing of the Plaintiff’s motion for certification of the class action will now be heard on March 9-11, 2015.

The certification motion requires rescheduling and new dates will be assigned shortly.

The initial Case Management Conference was held before the Honourable Justice Gerald Moir on September 6, 2013.

As a result of the conference, Justice Moir scheduled the dates of September 2, 3 & 4, 2014 for the hearing of the Certification Motion.

A further case management conference will be held on December 3, 2013 to schedule timeframes for filing the evidentiary record and briefs. Once a full schedule has been developed, it will be posted on this page.

The Honourable Justice Gerald Moir of the Supreme Court of Nova Scotia has been assigned to case manage this proceeding.
